What is PPWR Article 6 (Recyclable packaging)?

PPWR Article 6 mandates that all packaging placed on the European Union market must be recyclable by design. From 1 January 2030, packaging shall not be placed on the market unless it is recyclable within grades A, B or C as described in Table 3 of Annex II.

For years, brands and merchants selling into the European Union have dealt with a patchwork of packaging guidelines, where what was deemed recyclable in one country was sent to an incinerator in another. Brands often relied on theoretical recyclability, arguing that because a material could technically be melted down in a laboratory, it was perfectly fine to use. Article 6 of the Packaging and Packaging Waste Regulation puts an end to this ambiguity, introducing uniform, legally binding design requirements that apply across all member states.

The reality for merchants is that packaging compliance is no longer just about paying a registration fee and submitting annual tonnage reports. It is now a product design issue. If your boxes, mailers, or bottles do not meet the exact chemical and structural criteria laid out by the European Commission, they will be illegal to sell. You will have to rethink materials, adhesives, and inks well in advance, because the financial and market access penalties for non-compliance are severe.

What PPWR Article 6 (Recyclable packaging) actually means

At its core, Article 6 establishes two overarching tests that packaging must pass to remain on the market: it must be designed for recycling, and it must actually be recycled at scale. The regulation demands that packaging enables the recovery of secondary raw materials that are of sufficient quality to substitute primary raw materials (Packaging and Packaging Waste Regulation (EU) 2025/40). In practice, this means your packaging must not contain glues, barrier layers, or dark colourants that ruin a batch of recycled plastic or paper.

The European Commission is replacing vague sustainability goals with hard legal barriers. The most significant of these barriers is the performance grading system. Packaging will be assessed and assigned a recyclability performance grade of A, B, or C, based on how much of its weight can be successfully recovered.

From 1 January 2030, packaging shall not be placed on the market unless it is recyclable within grades A, B or C as described in Table 3 of Annex II.

This mandate completely removes low-performing materials from circulation. Packaging that scores below Grade C is considered technically non-recyclable. By 1 January 2028, the European Commission will adopt delegated acts that detail the exact design criteria for different material categories. Merchants will not need to conduct formal conformity assessments for recyclability until these specific delegated acts enter into force (Commission Notice - Guidance document for Regulation (EU) 2025/40 on packaging). Once they do, manufacturers will have 24 months to ensure their packaging complies, meaning the ban on non-recyclable packaging takes effect from 1 January 2030, or two years after the criteria are published, whichever is later. Furthermore, extended producer responsibility fees will be heavily modulated based on these exact grades, making high-performing packaging significantly cheaper to register.

Does this apply to me?

If you manufacture, import, or distribute packaged goods into any European Union member state, Article 6 applies to your operations. The basic requirement that all packaging placed on the market must be recyclable legally applies from 12 August 2026. However, the strict grading thresholds and market bans phase in later.

There are specific exemptions for products where altering the packaging design could compromise health or safety. Article 6 does not apply to the immediate packaging of medicinal products, contact-sensitive packaging for medical devices, or in vitro diagnostic medical devices. It also excludes contact-sensitive packaging for infant formula and food for special medical purposes, as well as packaging used for the transport of dangerous goods. Additionally, sales packaging made from lightweight wood, cork, textile, rubber, ceramic, porcelain, or wax is exempt from the recyclability requirements, as these materials make up a negligible fraction of the market. If your products do not fall into these narrow categories, you must prepare your supply chain for the grading system.

The grading system creates a moving target for compliance. While Grade C packaging is legally permitted from 2030, the regulation phases it out entirely by 1 January 2038, after which only Grade A and Grade B packaging can be placed on the market. Additionally, from 1 January 2035, the assessment will add a second layer: the packaging must not only be designed for recycling, but it must be proven to be recycled at scale in operational infrastructure.

Common misconceptions about PPWR Article 6 (Recyclable packaging)

“My packaging is technically recyclable in a laboratory, so I am compliant”

Theoretical recyclability will no longer be enough. The law demands that packaging is compatible with established collection and sorting processes proven in an operational environment. If the existing sorting facilities in the European Union cannot handle your specific material combination, it will fail the assessment.

“These rules only target single-use plastics”

While plastics face the heaviest scrutiny for recycled content, the recyclability rules in Article 6 apply to all packaging materials, including paper, cardboard, aluminium, steel, and glass. A heavily laminated paper box with foil stamping will face the exact same grading criteria and potential market bans as a complex plastic pouch.

“I do not have to worry about any of this until 2030”

While the Grade C threshold bans take effect in 2030, the general requirement that packaging must be recyclable applies from 12 August 2026. Furthermore, 18 months after the detailed criteria are published, member states will begin modulating extended producer responsibility fees based on these grades. Poorly designed packaging will cost you heavily in compliance fees long before it is officially banned.

“Small sellers are exempt from recyclability rules”

There is no small business exemption for the core recyclability requirements of Article 6. While micro-enterprises might see exemptions in other areas of the regulation, such as certain re-use targets or take-back reporting, any packaging placed on the European market must meet the design for recycling criteria.

5 examples of how Article 6 impacts packaging

Multi-material flexible pouches

A pouch made of mixed plastics with an aluminium foil barrier layer is notoriously difficult to recycle. Under the new rules, if the materials cannot be separated easily at sorting facilities to yield high-quality secondary raw materials, the pouch will likely score below 70 percent and be banned from the market.

Coloured or opaque PET bottles

Clear PET is highly prized by recyclers, but opaque or heavily dyed PET often disrupts the recycling stream and downgrades the quality of the output. The design criteria will penalise heavily dyed plastics, pushing manufacturers to switch to clear or lightly tinted bottles to achieve a Grade A or B score.

Paper mailers with heavy plastic linings

Many e-commerce brands use paper envelopes lined with bubble wrap to protect goods. Because the paper and plastic are fused together and cannot be easily separated by consumers or mechanical sorting plants, this packaging will struggle to meet the recyclability grades and will need to be redesigned as a mono-material solution.

Glass jars with non-magnetic steel closures

While glass is highly recyclable, the closures matter. If a glass jar uses a closure or tamper-evident seal made from materials that contaminate the glass recycling stream or cannot be efficiently separated during processing, the overall recyclability grade of the packaging unit will drop.

Wooden crates for luxury goods

A brand selling premium wine in a lightweight wooden box might worry about passing the 70 percent recyclability threshold. However, sales packaging made from lightweight wood is explicitly exempt from the Article 6 recyclability requirements, meaning the brand can continue to use it without facing the 2030 market ban.
