1Why EPR is different in every country
Selling cross-border in Europe means one thing for packaging compliance: there is no single checkbox for the continent. Extended Producer Responsibility for packaging was rolled out through the EU Waste Framework Directive 2008/98/EC, and a directive sets the goal while leaving the mechanics to each member state. So every country built its own register, appointed its own producer responsibility organisations, and set its own reporting cadence. If you sell into five markets, you register, track, and pay in five separate national systems.
The practical consequence: your compliance work multiplies by market, not by product. Germany runs the strictest, most heavily enforced regime (LUCID plus a paid dual system); France leans on labelling and the Citeo IDU; the Netherlands is removing its distance-seller exemption from August 2026. How the 2026 PPWR changes the picture
The Packaging and Packaging Waste Regulation (EU) 2025/40 takes general effect on 12 August 2026. Because it is a regulation rather than a directive, its rules on packaging design, void-fill minimisation, and recyclability grades apply identically across the Union. It does not replace national EPR: you still register, report, and pay in every country. What changes is that fees become tied to EU-wide recyclability grades, so a highly recyclable mono-material mailer earns lower fees everywhere at once, while hard-to-recycle composites are penalised everywhere.

- Is there a single EU-wide EPR registration?
- No. Extended Producer Responsibility is run at national level. You register, report, and pay packaging fees separately in every country where you ship goods to end consumers.
- What happens if I sell cross-border without registering?
- You risk administrative fines (up to EUR 200,000 in Germany), retroactive fee charges, and immediate delisting from marketplaces like Amazon and eBay.
- Will the PPWR centralise EPR?
- No. The Packaging and Packaging Waste Regulation applies from 12 August 2026 and harmonises packaging design and reporting formats, but the duty to register and pay fees stays national.
- Which countries have no minimum threshold for packaging EPR?
- Germany and France have a zero-kilogram threshold, so the obligation starts with your first package. The Netherlands removes its 50,000 kg distance-seller exemption from August 2026.
